A more useful question is: where does the value you want actually sit?

If the need is broad legal research from day one, with no build time, a commercial platform is often the right call. The same is true if nobody at the firm can own an internal system. Buying is not a compromise in that case. It is the sensible answer.

Custom starts to make sense under different conditions. When the edge lives in the firm's own precedents, playbooks and matter history. When the firm needs to control where data lives and how it is used. When per-seat costs grow faster than usage. Plenty of firms end up running both: a platform for general research and a custom system for firm-specific work.

The results from firm-specific builds can be concrete. At one US securities litigation firm, associates had spent two days in Westlaw for each opposition brief. After a custom system built on 12 GB of securities case law went in during 2025, precedent research time fell 55%, against a target of halving it.

Confidentiality is part of the same decision. In the US, ABA Formal Opinion 512 (July 2024) expects lawyers to understand how a tool retains and trains on data. In India, the DPDP Act, 2023 treats the firm as data fiduciary and the vendor as processor. With a custom build, those answers come from how the system was designed, not from a vendor's standard terms. (This is not legal advice; confirm with your ethics counsel.)

A practical takeaway: list your three most time-consuming legal workflows. For each, ask whether a generic tool could do it well without your firm's documents. Every "no" is a candidate for a custom build. Every "yes" is probably cheaper to buy.
